Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Arc Marksmanship Academy, LLC (“Arc Marksmanship Academy,” “we,” “us,” or “our”), a Georgia limited liability company, governing your access to and use of the Overwatch platform (the “Platform”).

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you are creating an account on behalf of a minor, you represent that you are the minor's parent or legal guardian and agree to these Terms on behalf of both yourself and the minor.

If you do not agree to these Terms, do not access or use the Platform.

2. Eligibility

Adult Users: You must be at least 18 years of age to create an independent account on the Platform.

Minor Users: Athletes under the age of 18 may use the Platform only through a parent or guardian account. The parent or guardian is responsible for all activity associated with the minor's profile.

Minor Users Under 13: Athletes under the age of 13 may not create independent accounts. All account creation and management for athletes under 13 must be performed by a parent or legal guardian in accordance with our Privacy Policy and COPPA requirements.

3. Account Registration

3.1 Account Creation

You may register using an email address and password, or through Google authentication. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at privacy@arcmarksmanship.com if you suspect unauthorized access to your account. We are not liable for any loss or damage resulting from unauthorized use of your account.

3.3 NFC ID Cards

Upon becoming an active member or registered course student, you will be issued an NFC identification card. This card is the property of Arc Marksmanship Academy and must be presented at all times while on academy premises. Lost or stolen cards must be reported immediately. A replacement fee may apply.

4. Membership and Enrollment

4.1 Membership Tiers

Arc Marksmanship Academy offers multiple membership tiers, each with different session allowances and benefits. Membership details, including pricing and included sessions, are displayed on the Platform and may be updated from time to time with notice to members.

4.2 Course Enrollment

Enrollment in courses is subject to availability, skill tier eligibility, and completion of the mandatory Safety Course. Arc Marksmanship Academy reserves the right to deny enrollment at its discretion.

4.3 Safety Course Requirement

All new athletes must complete the Arc Marksmanship Academy Safety Course before enrolling in any other course. The Safety Course is a paid course. Completion of the Safety Course does not guarantee placement in advanced courses.

4.4 Skill Tier Advancement

Skill tier advancement is at the sole discretion of Arc Marksmanship Academy instructors and administrators. Meeting minimum score thresholds does not automatically guarantee advancement. Advancement considerations include, but are not limited to, safety record, attitude, adherence to range rules, and instructor evaluation.

5. Payments and Billing

5.1 Payment Methods

Arc Marksmanship Academy accepts credit card payments and ACH bank transfers, processed through Stripe, Inc. By providing payment information, you authorize Arc Marksmanship Academy to charge your selected payment method for all fees associated with your membership, course enrollments, and other purchases.

5.2 Processing Fees

A processing fee, as configured by the academy and displayed at checkout, applies to all credit card transactions. No processing fee applies to ACH bank transfers.

5.3 Auto Top-Up

If you enable the auto top-up feature, you authorize Arc Marksmanship Academy to automatically charge your saved payment method when your account balance falls below a configured threshold. You may disable auto top-up at any time through your account settings.

5.4 Failed Payments

If a payment fails, your booking access may be suspended until payment is resolved. You will be notified of payment failures via email and/or SMS per your notification preferences.

5.5 Refund Policy

Arc Marksmanship Academy does not issue cash refunds for unused sessions or membership fees except as required by applicable law. In cases of excused absences approved by an administrator, makeup session credits may be issued at the sole discretion of Arc Marksmanship Academy. Makeup credits are non-transferable and expire 90 days from the date of issuance.

5.6 Cancellation Policy

Session cancellations must be made at least 12 hours prior to the scheduled session start time. Cancellations made less than 12 hours before a session, or failure to attend without cancellation, will result in forfeiture of the session credit. Arc Marksmanship Academy reserves the right to cancel or reschedule sessions and will notify enrolled athletes as soon as practicable.

6. Range Rules and Code of Conduct

6.1 Safety First

All athletes, parents, guardians, and visitors must comply with all range safety rules at all times. Failure to comply with range safety rules may result in immediate removal from the premises and suspension or termination of membership without refund.

6.2 Disqualification

Arc Marksmanship Academy reserves the right to issue the following disciplinary actions:

  • DQW (Disqualification Warning): A formal warning for a safety or conduct violation, logged on the athlete's permanent record.
  • DQ (Disqualification): Disqualification of a specific shot or round for a rules violation.
  • DQFD (Disqualified for the Day): Immediate removal from range activities for the remainder of the day for serious safety violations, including but not limited to dangerous firearm handling after prior warnings. Parents or guardians of minor athletes will be notified immediately upon issuance of a DQFD.

Repeated DQFDs or serious safety violations may result in suspension or permanent termination of membership.

6.3 Respectful Conduct

All users of Arc Marksmanship Academy facilities and the Platform are expected to treat staff, instructors, fellow athletes, and visitors with respect. Harassment, bullying, or threatening behavior of any kind will not be tolerated and may result in immediate termination of membership.

7. Waivers and Assumption of Risk

7.1 Liability Waiver

Participation in shooting sports activities involves inherent risks, including but not limited to physical injury. By enrolling in any Arc Marksmanship Academy course or activity, you acknowledge these risks and agree to execute all required liability waivers through the Platform prior to participation.

7.2 Minor Athletes

For minor athletes, the parent or legal guardian must execute all required waivers on the minor's behalf. Electronic signatures captured through the Platform constitute legally binding signatures.

7.3 Waiver Updates

Arc Marksmanship Academy reserves the right to update liability waivers from time to time. Updated waivers must be signed before continued participation in academy activities.

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of Arc Marksmanship Academy, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without our prior written consent.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at www.arcmarksmanship.com/privacy.

10. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Arc Marksmanship Academy does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Arc Marksmanship Academy, LLC and its members, managers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or participation in academy activities, even if advised of the possibility of such damages.

Our total liability to you for any claims arising out of or related to these Terms or the Platform shall not exceed the amount paid by you to Arc Marksmanship Academy in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Arc Marksmanship Academy, LLC and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.

Any dispute arising out of or related to these Terms or the Platform shall first be submitted to good-faith mediation. If mediation is unsuccessful, disputes shall be resolved by binding arbitration in Gwinnett County, Georgia, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Modifications to Terms

Arc Marksmanship Academy reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the “Last Updated” date. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the modified Terms.

15. Termination

Arc Marksmanship Academy reserves the right to suspend or terminate your account at any time for violation of these Terms, range rules, or for any other reason at our sole discretion. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to payment obligations, intellectual property rights, disclaimers, and limitation of liability.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arc Marksmanship Academy, LLC regarding your use of the Platform and supersede all prior agreements and understandings.
